You can file your taxes beginning 2 January. However, you need to have all your income documents (W-2, 1099-G for unemployment, etc). These are required to be mailed to you by 31 January, so it could be the beginning of February before you're ready to file.

Actually you can MAIL your tax return starting January 2, 2008 assuming you have all your necessary paperwork. The IRS does not start processing until the middle of January (if their computers are updated by then) and you can not electronically file until mid-January. If you go to a tax preparer before the IRS is accepting returns they can complete the return but they can not electronically submit it until the IRS gives the OK.

Can't file until January, and usually have to wait until February for the state to catch up their systems.
